Indians Promised “We Will Shut Down The Roads”– Now They Delivered

Burning Man doesn’t even begin for another 5 days, but the chaos has already started.

By now you’ve probably heard that basically every single vehicle driving along the 447 near Nixon is being searched by the police, often with K-9 units.

Law enforcement officers from both the U.S. Bureau of Indian Affairs and Pyramid Lake Paiute Tribe have been pulling over vehicles on their way to early Burning Man festivities in the Nevada desert. 

Bureau agents and tribal police were pulling over drivers passing through tribal land beginning last week and continuing this week. On Monday, about a half-dozen federal and tribal vehicles, some unmarked, were seen stopping vehicles primarily in Nixon, a tiny town halfway between Reno and the Burning Man site….There is one road, State Route 447, to and from the event; a large portion of that road goes through the Pyramid Lake Paiute Tribe’s land

The Pyramid Lake Paiute Tribal Council in the past month approved a memorandum of understanding that detailed the Bureau of Indian Affairs’ plans to have a law enforcement presence this year on the tribal land, according to tribal officials. The BIA  initially proposed the memorandum to the tribal police, which then presented the agreement to the council.

The tribe declined to provide the document, and the BIA has not responded to repeated calls for comment. It is unclear what the duration of the agreement is, and its purpose.

This is unprecedented in Burning Man history.

The RGJ for some reason did not make the connection between this new interference from the Bureau of Indian Affairs, and the cultural appropriation issues that were raised at the last Burning Man and through Burners’ involvement in the Standing Rock pipeline protests (see Dear Burners, Standing Rock is not Burning Man)

It was a really big story at the time, mostly in extremely heated social media discussions.

The Huffington Post had a suitably fawning puff piece on it – On Cultural Appropriation and Transformation at Burning Man – which sure looks like quickly produced damage control from the BMorg propaganda PR team. Then Caveat Magister hit the BJ with “Decommodification” and “Cultural Appropriation” – two great conversations that go great together. The usual self-congratulatory “we’re saving the world” stuff we’re used to from the official Voices of Burning Man.

What is it they say…“white man speak with forked tongue”? A couple of laissez-faire stories was not enough to put out this particular fire.

These people were seriously offended. Not just “hey fuck your fake headdress at Coachella” offended. More like “You have dishonored our ancestors and our entire tribe” offended.

It sure looks like they made good on their threats. It is going to take a long, long time for the 80,000+ total participants to all make it into Black Rock City, if every single vehicle is getting searched. Be prepared.

Is this another case where the hundreds of year-round staff in San Francisco failed to pay sufficient respect to the objections of the local community? It might be far out in the desert, but Burning Man isn’t an island. It needs to be a net positive for everyone.

I wouldn’t be surprised to see the Org try to spin this to blame the Trump Administration rather than themselves. The proof will be in the pudding when Burning Man opens: is this treatment coming from all the Feds and cops, or just on the Indian territory?

“The Org Shows Its True Colors Once Again”: Staff Ticket Scandal

The Org shows its true colors once again.

Fucking greed. Pure, unadulterated greed.

The Org has once again oversold the event, after coming within 60 attendees of the pop. cap last year. But as they say, actions have consequences:

This time the Org pulled earned tickets from departments. As in, people they bargained free labor last year in exchange for a ticket this year are being told AS THEY DRIVE IN to turn around and go home. These are people that were submitted on staff lists months ago. I’ve personally seen the confirmation emails from two list submittals to the Org.

Evidently, last Thursday the Org notified departments of their “oversight” and that they would not be honoring many staff tickets. DPW, Gate, ESD among others were all affected. Hundreds of workers for the event left holding the bag, many while enroute.

Keep it classy, Burning Man. First you hoodwinked so many to work for free, now you’re actually costing them money lost to preps, fuel, etc for an event they’re not even allowed into. To work. For you. For free.

What a fucking joke.

Completely true. The ORG oversold the event and now they are not honoring staff tickets and credentials earned last year. If your WAP/ticket was put into TicketFly in a timely manner and you have an e-mail from them; then you are good. If your department manager or the person they instructed to put the info into TicketFly didn’t for whatever reason (dropped the ball!) then you’re screwed. Even if you told them you would be attending and they confirmed.

I personally know at least 20 Gate personnel this affected. They are/were on their way to the event and were told to go home.

This is a tough message.
It is very hard to say this but very important to get the word out. Last Thursday every department at Burning Man was told that there were no more tickets of any kind available. This includes staff credentials, reduced price tickets, and gift tickets. Over the past few days we have been trying to see what kinds of resources we could muster to address the shortfalls we know we have. In most years we are able to continue issuing credentials and tickets up to the day before the event opens, and we can catch the persons that fell between the cracks.
Please check to see if you have an email confirmation from Ticketfly that has the words STAFF CREDENTIAL in it. If you can’t find one it is quite possible you do not have a ticket to Burning Man this year, and for that we are very sorry to disappoint you and break the promises we have made. This is the hardest message I have ever had to put on announce, and I fully expect to hear about it and will field all questions about this.

Sheriff Spat Escalates: “Misinformation”

The Federal tensions with the Bureau of Indian Affairs have been causing headaches for Burners, but there could be even more to come. It looks like nothing is being done to appease the Pershing County community. Quite the opposite, with Burning Man’s official statement accusing Sheriff Jerry Allen of disseminating misinformation: in other words, lying. A pissed off Sheriff is just one more problem for the lawyers, from the point of view of the Org; cops wanting to make more money off of Burning Man is a very real problem for Burners. Be careful out there: don’t give them any excuse to stop and search you.

Burning Man disputes county comments

In a rare public statement, a Burning Man spokesman questioned the accuracy of comments submitted to the BLM by Pershing County District Attorney Bryce Shields. The BLM accepted public comment as it evaluates the next ten-year Special Recreation Permit for the festival.

Roger Vind read a statement to county leaders during public comment. He asserted the county’s comments to the BLM are “inaccurate” due to “misinformation” provided by Sheriff Jerry Allen.

“It is unfortunate that misinformation propagated by the Sheriff has made its way into the County’s public comment,” Vind said. “We believe it is time for the Sheriff to be held accountable for his misstatements and mischaracterizations of our event.”

In his comments to the BLM, Shields suggested that Black Rock Rangers may have “filtered” crime reports by participants and that the BRR manual encouraged such behavior. As a result, crime reports could be less than the actual crimes committed at past Burning Man events.

“Anecdotal information from state and federal law enforcement officers suggests that the BRR encourages event participants to avoid reporting incidents to law enforcement in favor of resolving matters “in house” with the BRR’s assistance,” Shields said in comments to the BLM. “Such stories from law enforcement seem to be credible because the 2018 Black Rock Ranger (BRR) Manual contains instructions to BRRs to ‘filter’ what is reported to law enforcement.”

In his statement, Vind called it “absurd” to accuse Burning Man of stopping crime reports to law enforcement officers and that Black Rock Rangers have never been instructed to do so.

Our Black Rock Rangers in no way ‘filter’ information to law enforcement. In fact, there are 57 instances pertaining to law enforcement in the 2018 Black Rock Ranger Manual and the word ‘filter’ or any other reference to keeping information from law enforcement just does not exist.”

Vind also contradicted the implication by Shields that crimes at past events, including sexual assault, had been underreported to county law enforcement officers at Burning Man.

“This serious allegation is not only untrue but is contradicted by Sheriff Allen himself.”

Vind included an email from Allen regarding the need for a better definition of sexual assault.

“I do appreciate the lengths that BRC, with your assistance, has gone through to assist us in our endeavor to provide the best public safety we can,” Allen said in the email. “I also appreciate that you are instructing your Rangers to not inquire about penetration, or start an investigation, but rather to allow for the free flow of information from the potential victim.”

Allen later said the email text was accurate but that it was “grossly taken out of context.”

“That was a discussion about Burning Man’s internal policies which the Sheriff’s Office does not make,” he said. “I think their policies and some of their definitions are far out of line with Nevada Revised Statutes but I can’t make them change their internal policies.”

Allen said that, in his experience, “there have been things that have gone unreported.”

“Some of it may not be on Burning Man,” he explained. “Some of it may the culture that they are working within, some it may be training or some of it may be lack of training. I think that, to a certain extent, there are things that are unreported or underreported. But, I also think there are things that are over-reported or wrongly or out of the wrong context.”

Citing crime statistics, Vind challenged Allen’s allegations of “high levels of crime at the event.”

“It is just not true and our statistics bear it out,” he said. “Utilizing the verified data we have from PSCO and the BLM from 2010 through 2016, the event population grew 58 percent. However, person-on-person crime only increased by two — from 10 to 12 and drug citations increased only 34 percent which is well below the population increase.”

Vind added there were 12 person-on-person crimes at the 2017 event, the same number as in 2016. He criticized Allen for not completing his After Action Report until a year after the event.

We would have had 2017 data had Sheriff Allen followed through in a timely manner with his After Action Report for the 2017 event. Unfortunately, he delivered it at the late day of July 9, 2018,” Vind said in his statement.

[this is pretty rich given that BMorg’s own 2017 Annual Report was released in July 2018, and it appears the 2017 Afterburn Report came out at the same time]. Burning Man has a 100+ person year round workforce and a $50 million budget, much more than PCSO – Ed.]

Vind responded to Shield’s concerns over weapons at the event. In one case, law enforcement discovered an assault weapon, a handgun and a large amount of ammunition at Burning Man.

“With respect to the District Attorney’s comments about our Gate screening process: In a state where ‘everybody has a gun’ (as we were told by local law enforcement), there have been only a handful of firearms at the event over the past decade,” Vind said in the statement.

Allen and other county officials have said Burning Man, where nudity and illegal drugs are common, is no place for children. Vind countered the criticism with is own.

“Sheriff Allen repeatedly advocates the event be 21 and over despite our having demonstrated the event is tremendously safe for children,” he said. “We believe parents should be the judge of what’s best for their children, not the Sheriff. The Sheriff is entitled to his opinions. However, anecdotes are not date and repeating untruths does not make them true.”

[Last year children got to watch a man killing himself by jumping in a fire. It is not “tremendously safe for children”, it is a place where by attending you voluntarily accept the risk of serious injury or even death. How could anyone say that is “tremendously safe”? The Sheriff says “drugs are common at Burning Man”, BMorg says (basically) “the only drugs were the people who got citations, as the population grows less people are doing drugs”. Repeating untruths does not make them true…YMMV – Ed.]

Vind also said Shields suggestion to cap Burning Man attendance at a maximum of 50,000 participates “does little to address the issues we face now and in the future of the event.”

Allen believes the proposed 50,000 person cap is still too much for the county and the region. It has become increasingly difficult to recruit officers from other agencies to patrol Burning Man.

“I think even at 50,000 persons, it’s too much for this county to sustain in the long haul unless some things are vastly reworked within the settlement agreement,” he said. “Unless things improve for Pershing County and Pershing County law enforcement, 10,000 people would be the max that we could sustain over a long period of time. I think 100,000 people is beyond what Nevada could handle, not just northern Nevada.”

Burning Man critic Dave Skelton agrees the festival is already too big for Pershing County and, at 100,000 people, it could be too big for the BLM.

“We’re at the point where I don’t think it can get any bigger than what it is and I don’t think its sustainable now,” he said. “The BLM has indicated over the last two years, they have as many people out there as they can get their hands on. There are other things that happen this month.”

From Spanky’s Wine Bar to Sonoma Slut Shaming: Former Mayor Fights Back

Mainstream media is all abuzz with the news that Rachel Hundley, the former Mayor of Sonoma who is running for re-election to the Council and aims to be a role model for women, has been “slut shamed” with racy photos of her from Burning Man posted on a web site “Rachel Hundley Exposed” (now shut down).

A California councilwoman says someone is trying to “slut shame” her into dropping her re-election bid — by creating a website filled with scantily clad photos of her at Burning Man.

Rachel Hundley, a councilwoman in Sonoma, said she received a threatening email earlier this month, accusing her of “immoral and unethical” behavior and telling her to drop out of the city council race or her candidacy would be “one of full disclosures.”

“I was threatened by an anonymous coward,” Hundley, 35, said in a YouTube video last week, calling the ominous email, “nothing short of extortion.”

The email included a link to a now-disabled website called “Rachel Hundley Exposed,” which she said showed “scandalous” videos and photos mined from her social media accounts, showing her wearing only a bra and underwear at Burning Man, the free-spirited arts and music festival.

The site was seemingly created by an organization called “Sonoma Citizens for Peace and Cooperation,” the San Francisco Chronicle reported.

In Hundley’s video, which had over 20,000 views as of Tuesday, she owned up to managing a wine bar at a “consent-focused sex-positive theme camp” that is part of Burning Man.

“What was especially disturbing in this era of Me Too was the attempt to slut shame me for celebrating my body and for my attendance at Burning Man,” she said

Salon has done an excellent piece on the epidemic of suicides amongst Burning Man workers.

There is a great deal of concern about the high frequency of depression and suicide among Black Rock City LLC (BRC) workers. While several factors contribute to depression and suicide, and correlation is not causation, the fact remains that 3 suicides (in a year) is an astonishingly high rate for virtually any population so small, and more so because, while these deaths are mourned, they are not entirely unexpected.

To put this in perspective, the US Army in 2011 reported a peak of 22.9 suicides per 100,000 soldiers, which was the highest rate seen in a decade. Per 100,000 appears to be a standard metric for this sort of thing. Assuming the combined numbers of Gate, DPW and Rangers to be approximately 1,000 strong, that would mean a suicide rate of 300 per 100,000. Statistically speaking, Black Rock City’s staff are 13 times more likely to kill themselves in the off-season than veterans returning from active combat duty. Even in a “slow year”, where only one BRC worker commits suicide, that is still 4 times the Army’s highest recorded suicide rate.

The story has also been picked up by the Daily Mail, Rave Jungle, and EDM Tunes. There’s also a rebuttal piece on Medium. If the suicide rate is just standard, nothing special to Burning Man, then why are there no other festivals with such a high death toll?

The seven suicides in seven years were just for DPW workers. There have also been Burners who committed suicide at the event, or after the event, workers who died on the job, and tragic fatal accidents.

Burning Man’s official history traces its origins to a secret society known as The Suicide Club. Coincidence? Or dark irony?

Before this year, there were at least six deaths in Black Rock City. An additional number of Burners passed away after being evacuated.

The known deaths, reported by the Black Rock Beacon and other media or the Burning Man organization:

  • 2011 – Erika Kupfersberger, cerebral hemorrhage.
  • 2007 – Jermaine “Jerm” Barley, suicide by hanging.
  • 2006 – Adam Goldstone, a DJ with a known heart condition, died in RV after fainting.
  • 2005 – Sam Rich, a member of the fire-dancing group Controlled Burn, heart attack. Rich had sustained a head injury for which he was given stitches on Wednesday, the day before he died.
  • 2003 – Katherine Lampman, run over by art car she was exiting.
  • 2001 – A participant chose to run into a fire, according to the Afterburn probably the burning of Amazing Larry’s Lucky Seven Ages, the casino built into two large dice in the Deep Playa.

Among other event-related fatalities, an unidentified 52-year-old female Burner died in a Reno hospital after being transported from the Playa in 2010 because of an “unknown” medical condition, according to the Afterburn.

In 2005, a second Burner suffered cardiac arrest on the Playa and died that October after slipping into a coma in the hospital.

One fatality occurred from one of the two aircraft crashes in 2003. Barry Jacobs, the pilot of one of the planes, died after being hospitalized.

Two additional deaths in 2001 associated with the event included a Department of Public Works volunteer who died in a motor vehicle accident on the highway before the event and a second traffic fatality on Highway 447 during Exodus.

Michael Furey died in a motorcycle accident as the event was being set up in 1996.

Acton v Goodman Update: Judge Rules, Off To New York

In the YouTube truther trial of the century, CIA whistleblower Dave Acton (Sweigert) is suing cinema verite Faux News journalist Jason Goodman over his abuse of his “Crowdsource the Truth” channel with repeated acts of cyber-harassment or cyber-terrorism.

The judge in South Carolina has made his first ruling on the case. Judge Bristow Marchant denied defendant Goodman’s Motion to Dismiss. He has referred the case to the Southern District of New York, where the defendant operates his alleged racketeering organization from.

The judge reviewed 3 things:

  1. that the plaintiff has standing
  2. that subject matter jurisdiction exists
  3. that the case is not frivolous

The case passed the test, but South Carolina may not be the most appropriate place to deal with it. In the judge’s view, Goodman was in New York when he broadcast his “Clear and Present Danger” show featuring the alleged cyber-attack.

2018 Crime Scorecard: 43 Arrests

The Reno Gazette-Journal reports crime was about the same as last year (according to the Sheriff), or 26% less (according to the math). There were 2 arrests for domestic battery and 2 DUIs.

Sheriff Allen’s arrests at the event don’t include the unprecedented crackdown in tribal territory in the days leading up to the event.

Pershing County Sheriff Jerry Allen said the 43 arrests at Burning Man this year is on par with previous years.

Allen said arrests will continue despite the official end of event on Monday.  Last year, the Pershing County Sheriff’s Office arrested 58 people at Burning Man. Most were on charges of drug possession and trafficking of drugs…The majority of the arrests so far this year are also for drug possession and trafficking.

Of the 43, the sheriff’s office arrested two people for driving while under the influence at Burning Man and two for domestic battery. He said several involved obstruction of a public officer.

“People are still leaving the playa and recovering from a week of partying,” Allen said about the likelihood of more arrests into the coming week. “They are trying to orient themselves and coming to terms with reality.”

Where did the SHIFTPOD come from?

They were mentioned in an earlier Burning Man-related story in Fast Company. The author Daniel Terdiman followed up this year by taking one of the newer air-conditioned models out to the Playa.

From Fast Company:

The ShiftPod was originally created as an answer to things like the hexayurt. Longtime Burning Man attendee Christian Weber came up with the idea for something that could be set up quickly, that could withstand heavy winds, and that was big enough to stand up in. He definitely succeeded.

I love my first-gen ShiftPod, but I have to say, the second-gen version is a step up. It’s a bit bigger–enough to notice, for sure–it’s more reflective, which means it’s cooler inside during the hottest part of the morning, and it’s just a little more modern. It feels like a second-gen version. As well, it comes standard with what’s called a Blast Shield, a highly reflective cover meant to make it possible to sleep a little later in the morning, even when there’s no shade.

The consensus in my camp, where, amazingly, there were seven ShiftPods this year, was that the Blast Shield probably made it as much as 10 degrees cooler inside than without it. Given that the ShiftPod 2’s higher-reflectivity alone probably cuts 10 degrees over a first-gen version, you’re looking at up to 20 degrees less searing heat by moving from a coverless ShiftPod 1 to a v2 with a Blast Shield. That’s big.

#LimoCrash Investigation On Lift The Veil

A lot of things don’t add up about this limo crash. I started a Twitter thread gathering all the information and stories about it that I thought were interesting. It’s a rich tapestry, one that you won’t find anywhere else on the Interwebz. Why do so many mainstream media stories add so many details, and yet no mainstream media stories incorporate all these fascinating details? Are there seriously only like a dozen or two real journalists left in the wild?

So far I’m up to #120 noteworthy items in my thread. As I find more, I will keep adding it to this thread. It’s the craziest story I’ve found since I first got online in 1994. Which is really saying a lot!

Has Burning Man become rudderless without the leadership of founder Larry Harvey, who passed away earlier this year? Now that they have a $45 million budget, and a permanent year-round site gifted to them to the tune of about $7 million, are they finally able to…DO something?

Well…YMMV. Perhaps in this Brave New World of Millenials, the better part of a year spent Ideating qualifies as something profound and meaningful, an enormous and courageous action communally performed by all who participate.

Meanwhile in the comment section, Burners be like: close the airport. Stop selling out our culture. Charge camps for prime placement instead of allocating it through favoritism. Focus on ways to reduce the environmental footprint and waste generated. Stop making it hard for true Burners to participate while encouraging an influx of sparkle pony tourists. Don’t make us wait in line. Make it easier to get tickets.

Here’s an idea for you, BMorg. Throw Full Moon parties at Fly Ranch. Invite specific camps to come to each one, encourage mixing between the camps on a smaller scale than Black Rock City. Everyone gets to know each other like in the good old days (or Juplaya). Ask each camp to leave a permanent art contribution to the ranch. Offer art car storage with mechanical/electronic/paint services. Get all the art cars there, art cars bring crews who can bring crowds – or not, depending on what is needed to advance the cause. After a couple of years, you will have a enough energy there for a year-round community to thrive. Sell tickets to everyone to fund it. I mean, not that nature walks aren’t swell, but you can still offer that. We’re Burners, we don’t go all the way out there just for nature walks. Party in the hot springs? Now you’re talking…

Here’s a bonus one: spend some of that massive cash surplus you’re sitting on to purchase some trash compactors. We need to have recycling and waste management on the site, it’s not fair to the local community or environment that they should pay the price for Burner waste.
